Constitutional design

Definition

The deliberate structure and framework of the U.S. Constitution, created at the 1787 Constitutional Convention. The Framers designed a system of federalism, separation of powers, and checks and balances to balance effective governance with protection of individual liberties.

Examples

  • The Great Compromise created a bicameral legislature with proportional representation in the House and equal representation in the Senate
  • The Three-Fifths Compromise addressed how enslaved people would be counted for representation
  • The Electoral College was designed as an indirect method of electing the president
